Agreement to terms of use

Use of the boom-room.ru website (hereinafter referred to as the “Site”) automatically signifies your acceptance of these terms and conditions. Boom-room.ru (hereinafter referred to as Boom-room, "we", "us" or "our") reserves the right to change or supplement these terms and conditions at any time without special notice, and you agree to accept such changes.

Service description

The Site provides users with Services solely to search for information on the availability and prices of travel services: air tickets, train tickets, bus tickets, hotel rooms, car rentals, apartments for rent and travel insurance.
Terms of Service
1. Any adult and capable Internet user, regardless of geographic location, may use the Site.
2. You agree that the Site has the right to place advertisements on any pages.
3. The materials posted on the Site are available for viewing and reproduction by other users for personal purposes. Copying, distribution, publication and other use for commercial purposes of materials downloaded from the Site is not allowed. Responsibility for copying and illegal use of materials posted on the Site is borne by the persons and organizations that used these materials.
4. We strive to ensure the uninterrupted operation of the Site, however, we are not responsible for the possible complete or partial loss of the data provided by you and for the insufficient speed or quality of the Service.

Boom-room makes no warranties and/or conditions, express or implied, including, but not limited to, non-infringement of rights, security and accuracy, as well as warranties arising from customary business practice.

b) the quality of products and services, information and other materials, as well as the results obtained when using the Site will meet your expectations.

Boom-room information services

1. If it is impossible to perceive the meaning of the information on the Site to perform any action, the user can contact the operator of the Boom-room support service.
2. All actions performed by the operator of the Boom-room support service are carried out exclusively on the personal order and with the consent of the User.
3. Air agencies, carriers, hotels, and other providers of travel or other services on the Site are independent organizations and not agents or employees of Boom-room. Boom-room shall not be liable for the acts, errors, omissions, representations, warranties, breaches or negligence of such providers or for any loss, death, loss of property, or any other damage caused by them. Boom-room is not responsible for and does not refund the amount paid for the reservation in the event of delay, cancellation, overbooking, strikes, force majeure or other circumstances beyond our control, and also does not accept any responsibility for any additional costs, gaps, delays, changes route or action by the government or authorities.
4. All contracts for the provision of transportation services, hotel reservations, insurance and other services, information about which is posted on the Boom-room website, are concluded by the User directly with the providers of these services (agencies and airlines) during the purchase process.
5. The user is solely responsible for losses incurred as a result of his actions on the Site, as well as actions performed through the Boom-room support service on his behalf and on his personal order.
6. After receiving an electronic ticket or an electronic confirmation of any booking (a document used to certify a contract for the carriage of a passenger or its accommodation, in which information is provided in electronic digital form), the User is obliged to check the correctness and correctness of all data. If an error is found, the User is obliged to contact the supplier and report it within 8 hours after receiving the booking confirmation (but no later than 24 hours before departure or check-in). For further advice, the User can contact the Boom-room support service.
7. The message to the operator of the Boom-room support service of any data identifying the user is an analogue of the latter's handwritten signature and is recognized as an unambiguous and indisputable confirmation of the user's orders, requirements, notifications and other actions.
8. The Boom-room support service is not responsible for interruptions in the provision of services in the event of software or hardware failures, as well as for complete or partial interruptions in the provision of services related to the replacement of equipment, software or other work caused by the need to maintain the Site's performance.

Conditions for posting materials
1. The user assumes full responsibility for the materials posted by him on the Site. If it is established that the user who posted the material is not its copyright holder, this material will be removed from the Site at the first request of the copyright holder.
2. The User undertakes not to place on the Site (including personal pages) materials that advertise any goods or services without our consent.
3. The User undertakes not to post materials on the Site that contain insults, threats, are obscene or violate the rights of others, as well as containing malware and computer viruses. In case of violation of these terms, we reserve the right to remove these materials without special notice. In case of repeated violation of the conditions, the user may be denied the provision of the Service.
4. In accordance with this Agreement, the user is responsible for any costs, damages and other costs, including, but not limited to reasonable compensation for the work of lawyers and accountants, arising out of or in any way related to a violation of this Agreement.

Disclaimer

Boom-room excludes its liability for:
1. any contingency, accident, delay or special, punitive, consequential or additional damages of any type (including but not limited to lost profits), strict liability or otherwise arising out of: (i) any use of Site; (ii) an error or delay (including, without limitation, the use or inability to use any part of the Site for searching or booking purposes; or (iii) any action or omission by us or another user, even if we have been advised of the possibility of damages to these persons or another person.

Payment Rules:

  1. Payment Methods: The tour operator accepts payment via Visa and Mastercard cards.
  2. Currency: All transactions are conducted in the currency specified on the tour operator's website or in the contract.
  3. Deposit: To confirm a booking, the client must make a deposit. The deposit amount may vary depending on the type of tour and the departure date.
  4. Final Payment: The remaining amount is paid by the client within the timeframe specified in the contract or on the website. Typically, this is done several weeks before the tour begins.
  5. Fees: The tour operator may charge fees for using specific payment methods (e.g., credit card payment). These fees should be clearly stated on the website or in the contract.

Refund Rules:

  1. Tour Cancellation: If the client decides to cancel the tour, they must notify the tour operator as soon as possible.
  2. Deposit Refund: Refund rules for the deposit may vary depending on the time before the tour's start. For instance, if the cancellation occurs well in advance of the tour, the client may receive a full or partial deposit refund.
  3. Remaining Amount Refund: If the client has already paid the remaining amount, refund rules may be stricter. Refunding the remaining amount may only be possible in case of significant circumstances, such as illness or extraordinary events.
  4. Penalties: The tour operator may impose penalties for tour cancellations depending on the time before the tour's start. The closer the cancellation is to the departure date, the higher the penalties.
  5. Commission Refunds: Commissions paid for using payment methods are typically not refundable.
  6. Refund Procedure: The client should contact the tour operator to inquire about the refund procedure and provide any necessary documents (e.g., a medical certificate in the case of illness).
